Additionally, we offer an optional background check service for a fee of R500.

3. User Registration

To use certain features of the Platform, you may need to register for an account. You agree to provide accurate and complete information during the registration process, and to update your information if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Employer Responsibilities

As an employer, you are responsible for:

  • Conducting your own due diligence on any candidate, including verifying qualifications, references, and background.
  • Ensuring that the candidate is suitable for the role and complies with applicable laws and regulations.
  • Requesting and paying for any background checks and verifying the results.
  • Ensuring proper training, supervision, and management of any candidate hired.
  • Conducting reference checks and any other necessary verification steps before hiring a candidate.

5. Candidate Responsibilities

As a candidate, you are responsible for:

  • Providing accurate, complete, and truthful information in your profile.
  • Maintaining your profile and ensuring that it reflects your current skills, qualifications, and experience.
  • Not misrepresenting yourself or your qualifications.

6. Optional Background Check Service

Pixeltide (PTY) LTD offers an optional background check service at a fee of R500. Employers can request this service through the candidate’s profile. While this service provides a review of publicly available records, Pixeltide (PTY) LTD makes no guarantee about the accuracy, completeness, or reliability of the information provided, nor does it guarantee the candidate’s performance. Employers are responsible for conducting their own verification and assessments.

7. Limitations of Liability

Pixeltide (PTY) LTD is not responsible for:

  • The accuracy or reliability of any candidate’s information.
  • The performance, behavior, or suitability of any candidate.
  • Any issues that arise from the employment relationship between the employer and the candidate.
  • Any losses, damages, or legal claims arising from the hiring process or the performance of candidates.

By using the Platform, you agree to hold Pixeltide (PTY) LTD harmless from any and all claims, damages, liabilities, and expenses arising out of or in connection with your use of the Platform.

8. Intellectual Property

All content, features, and functionality on the Platform, including but not limited to text, images, logos, graphics, and software, are the property of Pixeltide (PTY) LTD or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or use any content from the Platform without express written permission.

9. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful or unauthorized purpose.
  • Violate any applicable laws or regulations.
  • Impersonate any other person or entity, or provide false or misleading information.
  • Attempt to gain unauthorized access to the Platform or any related systems.

10. Termination

Pixeltide (PTY) LTD reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, for any reason, including if you violate these Terms or engage in conduct that is harmful to the Platform or other users.

11. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which can be found at https://goodhelp.org.za/privacy-policy/. By using the Platform, you consent to the collection and use of your personal data as described in the Privacy Policy.

12. Dispute Resolution

Any disputes arising out of or related to these Terms or your use of the Platform shall be resolved through informal negotiations. If a resolution cannot be reached, the dispute will be submitted to binding arbitration. The venue for arbitration will be Johannesburg.

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

14. Indemnity

You agree to indemnify and hold harmless Pixeltide (PTY) LTD, its affiliates, employees, officers, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or any infringement of third-party rights.
